The 50-50 Problem

A legal case has come up in the German Constitutional Court.  SWR did a report summary of lawsuit and results....which probably won't be on page one or page two of most German newspapers.

For those who aren't aware of it....representation in the Bundestag in Berlin....is mostly men.  You'd have to watch dozen hours per month of their business, and then you'd start to count around the big room....men make up 70-percent of the representatives there in the German capital building.

So women took to the court system for a parity law....basically that the judges would see the logic that women make up half of society....so half of the Bundestag MUST be female.

Where this is going to go?  Unknown.

You'd have to write a hundred-page law (I suspect) to say that each party in each district would have to have some process where you 'game' the system to allow final representation to be even.  I'm pretty sure that political folks would tell you that it's near impossible to find the wording to fit this type of dilemma.

Would things then improve at the Bundestag?  Well....you don't know.

To be honest, once you settled on this type of law....you could mandate that the German Constitutional Court itself would have to be 50-50.  Then you'd go to the police, the firemen, and doctors.....mandating they be 50-50.  Economic professors, garbage truckers, mafia operations, etc....they'd also have to find some way to be 50-50.

I'm guessing the judges are sitting there and really trying to find the words to say this might not be feasible.

Update: 3 Feb 2021.  The eight judges from the Constitutional Court stood up and said 'no', then tossed the challenge back to the lawyers....saying they didn't really provide enough reasons why there had to be a 50-50 mix on genders in the Bundestag.  I'll admit, if you get this deep into managing things....you'd have to arrange the ministers by some 50-50 mix, and then it'd drag up the whole question of Chancellor....would have you have two Chancellors (male and female) and alternate them week by week?
