'Saboteur' Story

A couple of weeks ago....the front man for the CSU (the Bavarian 'cousin' of the CDU)....Alexander Dobrindt came up with a new attack phrase....'anti-deportation industry'.  The phrase centers on Germans who are working hard to prevent deportations.  Several folks from the Green Party and the Linke Party went ballistic over the commentary.  The story got picked up by ARD (public TV, Channel One).

Well....this weekend, Dobrindt went to the next comment....talking about "deportation saboteurs".  These are individuals who want to overload the German court system with legal action against deportation.

Almost every single failed visa applicant in Germany has file legal documents to challenge the BamF decision in court.  The judges?  Based on comments back in March....occasionally, they will find fault with the BamF decisions, but the majority of decisions have withstood the review of the court.

The problem here is that the general public has an opinion....whether true or not....that once you fail a visa application....your time remaining in Germany ought to be limited, and not dragged out.  Adding to the public discomfort....those with criminal records being supported via the legal challenges in court.  It does in some way.....damage the public opinion.

Adding to the episode becoming a major topic....the German Bar Association spoke to this Dobrindt comment (anti-deportation industry) last week....as being an attack on the rule of law.

I sat and pondered upon what has happened here.  Germany has truly become a nation consumed with laws, and there are various laws on the books which you effectively use to challenge just about any circumstance.  You just need some trained legal help to file the court documents and let nature take its course.  The term 'saboteur'?  Well....it might be going over the line, but these people really don't know the clients, or the files used to disqualify the failed applicant from the visa.  The fact that this guy might have been picked up for drug sales two or three times?  The legal help has no idea....nor do they care.  The vast number of failed applicants probably have no criminal record....but they didn't fit into the profile that BamF established for acceptance, and on this....again, the legal help doesn't care.
